The Lahore High Court judge Mr Justice Sadaqat Ali Khan has strictly instructed the Returning Officer of By-Election NA-62 Constituency Ms Nosheen Israr to implement all the rules and regulations as per the law during the NA-62 Constituency By-Election in Rawalpindi.
This direction was given by Mr Justice Sadaqat Ali Khan on an election petition by Azmat Ali Mubarak a candidate of National Assembly NA-62 Azmat Ali Mubarak.
In the election petition, the candidate NA-62 Azmat Ali Mubarak Advocate demanded that Sheikh Rasheed’s nomination papers reject.
He said that the RO Nausheen Asrar completely ignored the election rules in the process of approving and verifying the nomination papers of Sheikh Rashid, which benefited him.
”Sheikh Rasheed travelled abroad but did not write the name of the country”.
”Mandatory new bank account for the by-election has not been created”, identity card copy of endorser and proposer has not been certified” and it has been said that they do not comply with Article 62”.
Sheikh Rasheed has serious allegations, nominated in criminal cases as well.
”Sheikh Rasheed is not only nominated in criminal cases but there is no proof of Lal Haveli which he is claiming to own”,
Sheikh Rashid’s nephew Rashid Shafique who is himself a candidate from NA 60 appeared before the returning officer during the scrutiny of nomination papers.
It is legally wrong for a candidate to appear in place of another candidate.
Azmat Ali Mubarak, an independent candidate from NA-62, advocate, in a 2-page written objection said that his rival candidate from NA-62, Sheikh Rasheed, requirements of nature under which it is legally necessary to reject his nomination papers.
He did not come to submit his nomination papers with clean hands. Sheikh Rasheed does not fulfill the conditions of Article 62 of the election Act . Such a candidate is not eligible to participate in the election after hiding the facts.
