ISLAMABAD Oct. 27 (TNS): Goons of land mafia have killed an innocent woman during an attempt to illegally occupy a piece of land.

According to FIR No. 292 registered at Sehallah Police Station, DHA and Bahria Town officials including Col (R) Waseem, Col (R) Khaleel and Bashir Aalam armed with sophisticated and automatic weapons stormed the land of a poor family at Canal Model Town Humak adjoining DHA/2.

On resistance, Bashir Aalam hit Ansar Mehmood with a rod, during brawl women of family started crying for help. Col (R) Waseem opened fire on a woman named Marouf Bibi then he shot her on chest.

The victim succumbed to her injuries while being shifted to PIMS hospital.

The victim’s family in the FIR mentioned that this murder was carried out on the orders of Col (R) Ijaz Secretary DHA, Land Director Brigadier Ibrahim and Haji Amjad Land Director Bahria Town to occupy their land adjoining their housing society.

This is not the first time that the chief executive of Bahria Town has allegedly been involved in murder case. According to a report published in October 2017, police registered an FIR against property tycoon Malik Riaz, his son Ali Riaz, and the Bahria Town management in a land-grabbing case more than a week after a local court issued orders to this effect.

Additional district and sessions judge (ADSJ) Sikandar Khan had ordered local police on Sept 21 to book the accused on the complaint of a widow and other residents of Phulgran, located in the suburbs of the federal capital.

Bhara Kahu police registered the FIR on Sept 29 under sections 109, 341, 379, 427 and 447 of the Pakistan Penal Code (PPC), which deal with theft, wrongful restraint, mischief and criminal trespass.

Advocate Yasir Ali, one of the complainants, told the media he had inherited just over eight kanals of land worth approximately Rs80-90 million in the Phulgran revenue estate, which was illegally occupied by Bahria Town.

Judge ordered police to only arrest accused if ‘sufficient evidence’ was available.

He said that when he visited his family land on July 26, he found them occupied by Bahria Town guards. He claimed that he also approached the Bahria Town office located on Murree Expressway, near Satra Meel.

“I showed them the ownership documents, but they said the matter was not in their hands,” he said, adding that when he initially approached Bhara Kahu police to lodge a complaint, the station house officer and other officials refused to entertain him.

He said that he had approached the district courts and filed a petition seeking the registration of a case.

The complainant told the court that the property tycoon had illegally grabbed his inherited land and included it in his private housing scheme.

Mustafa Tanveer, counsel for Malik Riaz, told the court that the issue regarding the ownership of the land in question was pending before a civil court.

He alleged that the complainants had filed the petition for the registration of an FIR against Malik Riaz and his son in a bid to blackmail them, and argued that since the matter was pending before a civil court, criminal proceedings could not be initiated.

In the order, however, the ADSJ observed that pendency of a civil suit is not a bar against criminal proceedings, as both can proceed simultaneously.

But in his order, the judge noted that it was not necessary to arrest an accused as soon as the FIR was registered, and directed that police should only take the accused into custody when a cognizable offence was proven during the course of the investigation.

“It is to be clarified here that when an FIR is registered it is not necessary that in all cases the accused should be arrested. The accused may be arrested only in those cases where sufficient evidence comes on record against the accused,” the order read.

Moreover, “if during investigation, the information provided by the petitioner is proved false, local police may initiate strict proceedings under Section 182 (invoked against false accusers) of Pakistan Penal Code against the informant for providing false information”, the order further stated.

When contacted, Bahria Town spokesperson retired Col Mohammad Khalil told the media that the housing society had lawfully purchased the land in question.

He admitted there was a minor dispute between the society and locals, adding that the case was pending before a civil court in Islamabad.

However, he alleged that locals had filed an application seeking the registration of an FIR against Bahria Town high-ups with mala fide intent, to pressure the housing society into giving them a better deal.

In another case last year in March Malik Riaz’s son was booked by the local police as the prime suspect in an attempted murder case, while his father, a property tycoon, was listed as a suspect in a case registered with Rawat police, police sources said.

In an FIR, Dhoke Sahang resident Mohammad Tariq told police that he was at his shop with Ghulam Abbas at midnight when Malik Ali Riaz, Malik Farhat, Haji Amjad Mehmood and Malik Jahangir and between 100 and 150 other armed individuals arrived.

Malik Ali Riaz and Malik Jahangir threatened them and told them to leave as the area is located within the limits of Bahria Town.

“I told Ali Riaz that we were poor people and had been residing there for 100 years; how can we leave this place,” Mr Tariq said in his FIR.

He added: “Despite our efforts, their anger did not cool. Malik Ali Riaz, who was carrying a 9mm pistol, opened fire and Malik Farhat shouted at him to kill Ghulam Abbas, and he was shot.”

He said Haji Amjad Mehmood, Malik Farhat and Malik Jahangir also opened fire, and that Mr Abbas was injured. He said that upon hearing gunshots, a number of villagers arrived at the scene.

Mr Tariq said that the villagers who came to their rescue also asked Malik Ali Riaz and Malik Jahangir for “mercy”, but their pleas fell on deaf ears, and they were told to vacate the land within a day. The injured was later moved to a hospital, where doctors said he was in critical condition.

In his FIR, Mr Tariq said that his village is located in the middle of Bahria Town Phase 8.

He said they do not want to sell the land because the village elders have resided there for 100 years, but Bahria Town’s management wants to occupy their land.

He said that Malik Ali Riaz and Malik Jahangir, armed with assault rifles, attempted to get the land vacated after they saw the villagers were unwilling to sell the land.

He claimed they were acting on the instructions of Bahria Town’s Malik Riaz, and forcibly tried to occupy the land, targeted Ghulam Abbas, and spread terror throughout the village.

He said the four men, and others, also targeted his brother.

Bahria Town spokesperson and Malik Riaz’s personal staff officer, retired Col Khalilur Rehman said that Malik Ali Riaz has been in Dubai for the last three months, and so his involvement in the case was false.

When asked about the allegation leveled against Malik Riaz, he said that when an accused has not been in the country for the last three months, how the allegation could be true.

Rawat Station House Officer Malik Rafaqat told Pakistani media that the police will investigate all the suspects identified in the FIR registered with police based on the complaint by Mr Tariq.

In yet another case in June 2012 a petition to register a case against Malik Riaz was submitted in the Supreme Court. The petition was brought forward to the apex court by Dr Shafiq-ur-Rehman. The petition stated a case be registered against Malik Riaz on charges of murder. The accuser stated that Malik Riaz was involved in the murder of (retd) Lt Gen. Imtiaz Hussain and Dr Mansoor Janjua.

The petition stated that their murders were connected with a humongous exchange of approx Rs 62 Billion in Bahria Town DHA scheme. The petition prayed the court to register a murder case against the accused Malik Riaz with immediate effect.

Even if the FIR is correct in the recent case of murder, does anyone believe that action will be taken against the accused? We are sure everyone will say big “NO”. Such are the lowest points for the collective conscious of the society as a whole. Think please.
