Supreme Court dismisses contempt case against Senator Rehman Malik

Islamabad, March 21 (TNS): Supreme Court of Pakistan on Wednesday dismisses contempt of court proceedings against former Interior Minister Senator A. Rehman Malik.

Heading a three member bench of Supreme Court, Chief Justice Mian Saqib Nasir said the impugned order dated March 18, 2013 passed was not sustainable in law and is thus liable to be dismissed.

A contempt of court in Pakistan Steal Mills case was initiated by then Chief Justice of Pakistan Iftikhar Muhammad Chaudhray.

Former Interior Minister Rehman  Malik had filed an Intra Court Appeal (ICA) against the said contempt notice  on March 18, 2013 which was heard by a five members bench of the apex court who after hearing set aside the case.

Senator A. Rehman Malik the then Interior Minister was served show cause notice by then CJP on two points:

  1. Why the Interior Minister had enlarged the scope of investigation of Pakistan Steel Mills by adding technical experts.
  2. Senator A. Rehman Malik interfered in the investigation by transferring Mr Tariq Khosa out of the FIA.

The then Interior minister Senator A. Rehman Malik had filed his response that he  had enlarged the scope of the investigations to submit a report to the National Assembly as per his commitment at the floor of the house more over interior minister has ordered initial investigation 27 days before the Sou Moto of the then CJP Ch. Iftikhar.

Senator A. Rehman Malik successfully proved before the court that as Interior Minister was not competent authority to transfer an officer of grade 21 out of the FIA whereas Tariq Khosa a most competent with high integrity was promoted to Grade 22 and was posted out by the then PM who was the competent authority.

His transfer from FIA was because the reason of his promotion from grade 21 to grade 22.

Senator A. Rehman Malik while speaking to media outside Supreme Court of Pakistan said that he has great respect for law, judiciary and courts and he cannot think of disobeying any court.

He said in the said case he had been appearing before the court since 18-3-2013 and today he received the justice for which he is thankful to Supreme Court of Pakistan and Chief Justice Mian Saqib Nisar.

He said that in his Intra Court Appeal, the SC larger bench had set aside the order on 15-2-2016 terming it “we have no hesitation to hold that the impugned order dated 18.
