{"id":113623,"date":"2023-02-23T15:32:55","date_gmt":"2023-02-23T10:32:55","guid":{"rendered":"https:\/\/tns.world\/?p=113623"},"modified":"2023-02-23T15:32:55","modified_gmt":"2023-02-23T10:32:55","slug":"kp-punjab-election-wont-tolerate-violation-of-the-constitution-says-cjp","status":"publish","type":"post","link":"https:\/\/tns.world\/?p=113623","title":{"rendered":"KP, Punjab election: Won\u2019t tolerate violation of the Constitution, says CJP"},"content":{"rendered":"<p>Chief Justice of Pakistan Umar Ata Bandial said on Thursday that the Supreme Court will not tolerate the violation of the Constitution as the top court began its suo motu hearing to determine who has the constitutional responsibility and authority to announce the date for elections to a provincial assembly after it was dissolved in different situations, under the Constitution.<\/p>\n<p>A nine-member bench, headed by CJP Bandial and also comprising Justice Ijaz ul Ahsan, Justice Syed Mansoor Ali Shah, Justice Munib Akhtar, Justice Yahya Afridi, Justice Sayyed Mazahar Ali Akbar Naqvi, Justice Jamal Khan Mandokhail, Justice Muhammad Ali Mazhar and Justice Athar Minallah, heard the case.<\/p>\n<p>The hearing comes after President Dr Arif Alvi on Monday\u00a0unilaterally announced\u00a0April 9 as the election date in both provinces after his invitation for consultations on the matter was turned down by the Election Commission of Pakistan (ECP).<\/p>\n<p>At the outset of the proceedings today, CJP Bandial noted that the court had to look into three things and maintained that time for provincial elections was running out.<\/p>\n<p>Here, Barrister Ali Zafar took the rostrum and said that he wanted to bring \u201cthings related to the president on record\u201d.<\/p>\n<p>Meanwhile, the CJP stated that Alvi had announced the date for elections under Section 57 (notification of election programme) of the Elections Act, 2017.<\/p>\n<p>\u201cOur request is also pending, please listen to us,\u201d Zafar pleaded.<\/p>\n<p>However, the top judge reiterated that the court had three matters to look into. \u201cWe have to see who has the authority to give the election date after the dissolution of the assemblies.<\/p>\n<p>\u201cThe high court\u2019s Feb 10 order was in front of us,\u201d he said, adding that the court had a lot of factors in front of it.<\/p>\n<p>At one point during the hearing, the attorney general sought time from the court in the case. \u201cIf notices are issued to so many people, it will be difficult to prepare for tomorrow\u2019s hearing,\u201d he said.<\/p>\n<p>At that, the CJP said that the court will restrict itself to essential things, adding that the detailed hearing of the case will be held on Monday.<\/p>\n<p>He went on to say that a suo motu case was taken due to a number of factors. \u201cProlonged proceedings are underway in the high court but time is passing by.\u201d<\/p>\n<p>CJP Bandial observed that the Constitution decides the time for elections which is ending. \u201cThe high court\u2019s forum can be bypassed if there is an emergency. It was easier for us to fix two petitions \u2014 filed in the SC \u2014 for hearing.\u201d<\/p>\n<p>\u201cSection 57 deals with the date of elections,\u201d he stated, pointing out that several new points had emerged in the case that needed to be explained.<\/p>\n<p>The top judge further asserted that the Supreme Court will not tolerate the violation of the Constitution. \u201cIf there is a very serious situation, the time for elections can be extended. But we have to see if the Constitution is being implemented.\u201d<\/p>\n<p>\u201cWe want to implementation of the Constitution.\u201d<\/p>\n<p>Moreover, the CJP highlighted that after President Alvi\u2019s announcement of the election date, the situation changed. \u201cThe Supreme Court only has to see the constitutional point and implement it.\u201d<\/p>\n<p>He observed that elaboration was needed on the issue of elections and assured all the parties that the court would listen to their arguments.<\/p>\n<p>\u201cWe have suspended our schedule for the next week so that we can hear this case,\u201d CJP Bandial.<\/p>\n<h2><a id=\"pbc-seeks-changes-in-larger-bench\" class=\"heading-permalink\" title=\"Permalink\" href=\"https:\/\/www.dawn.com\/news\/1738710\/kp-punjab-election-wont-tolerate-violation-of-the-constitution-says-cjp#pbc-seeks-changes-in-larger-bench\" aria-hidden=\"true\"><\/a>PBC seeks changes in larger bench<\/h2>\n<p>Ahead of the hearing, the Pakistan Bar Council (PBC) said that CJP Bandial should not exclude Justice Qazi Faez Isa and Justice Sardar Tariq Masood from the bench constituted to hear the case to \u201cmake its (bench\u2019s) image impartial and neutral\u201d.<\/p>\n<p>&nbsp;<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right    media--uneven  media--stretch\">\n<div class=\"media__item media__item--zoomable\"><picture><img decoding=\"async\" src=\"https:\/\/i.dawn.com\/primary\/2023\/02\/231450561162d30.jpg\" alt=\"\" \/><\/picture><\/div>\n<\/figure>\n<p>&nbsp;<\/p>\n<p>In a press release issued by PBC Executive Council Chairman Hassan Raza Pasha and Vice-Chairman Haroonur Rashid, the PBC said their inclusion was necessary so that the \u201cpublic and lawyers community may not question upon the bench for hearing of [the] important matter in respect of the determination of constitutional responsibility and authority\u201d.<\/p>\n<p>The PBC also called upon Justice Naqvi to \u201cvoluntarily recuse\u201d himself from the bench, \u201cwhich the propriety demands from him\u201d. Justice Naqvi is one of the two judges that Interior Minister Rana Sanauallah\u00a0<a href=\"https:\/\/www.dawn.com\/news\/1738527\">said<\/a>\u00a0PML-N would move to be recused from hearing cases pertaining to the PML-N leadership.<\/p>\n<h2><a id=\"cjp-takes-notice\" class=\"heading-permalink\" title=\"Permalink\" href=\"https:\/\/www.dawn.com\/news\/1738710\/kp-punjab-election-wont-tolerate-violation-of-the-constitution-says-cjp#cjp-takes-notice\" aria-hidden=\"true\"><\/a>CJP takes notice<\/h2>\n<p>On Wednesday night, the top judge took\u00a0suo motu notice\u00a0of the delay in holding polls in Punjab and Khyber Pakhtunkhwa, saying that there appeared to be a \u201clack of clarity\u201d on the matter.<\/p>\n<p>In the notice, CJP Bandial said that the SC bench would consider the following questions:<\/p>\n<ul>\n<li>Who has the constitutional responsibility and authority for appointing the date for the holding of a general election to a provincial assembly, upon its dissolution in the various situations envisaged by and under the Constitution?<\/li>\n<li>How and when is this constitutional responsibility to be discharged?<\/li>\n<li>What are the constitutional responsibilities and duties of the federation and the province with regard to the holding of the general election?<\/li>\n<\/ul>\n<p>In his order, the CJP observed that there was, to put it shortly, a lack of clarity on a matter of high constitutional importance.<\/p>\n<p>The issues raised require immediate consideration and resolution by the Supreme Court. The decision was taken after a\u00a0note was presented to the CJP\u00a0against the backdrop of a Feb 16 order by a two-judge bench asking the chief justice to invoke a suo motu initiative in this regard.<\/p>\n<p>\u201cSeveral provisions of the Constitution need to be considered, as also the relevant sections of the Elections Act 2017. In particular, the issues involve, prima facie, a consideration of Article 17 of the Constitution and enforcement of the fundamental right of political parties and the citizens who form the electorates in Punjab and Khyber Pakhtunkhwa to exercise their right to elect representatives of their choice to constitute fresh assemblies and the provincial cabinets,\u201d the SC order said.<\/p>\n<p>\u201cThis is necessary for governments in the two provinces to be carried on in accordance with the Constitution,\u201d observed the CJP, adding that these matters involve the performance of constitutional obligations of great public importance apart from calling for faithful constitutional enforcement.<\/p>\n<p>\u201cThere is a material development in the last few days,\u201d the CJP noted, adding that it appeared that subsequent to certain correspondence initiated by President Arif Alvi with the Election Commission of Pakistan, the former had taken the position that it was he who had the authority and responsibility for appointing a date for the general elections, in terms as provided in Section 57(1) of the Elections Act.<\/p>\n<p>The order said: \u201cBy an order made on Feb 20, the President had appointed April 9, 2023 to be the date for the holding of the general elections in Punjab as well as KP and had called upon ECP to fulfil its constitutional and statutory obligations in this regard.<\/p>\n<p>More than one month has now elapsed since the dissolution of the provincial assemblies and it seems prima facie that even the matter of appointing the date of general elections which was a first step towards the holding of the elections, has still not been resolved, the judge remarked.<\/p>\n<p>\u201cConstitutional authorities appear to hold divergent and perhaps even conflicting, views on the issue, and thus several federal ministers appear to have contested the authority asserted by the president. Since ministers act under the constitutional rule of collective responsibility, it appears, prima facie, that this is the view taken by the federal cabinet as a whole.<\/p>\n<p>\u201cIt is also to be noted that statements attributed to ECP have appeared in the public record to the effect that it was not being provided the requisite assistance and support, in particular by the provision of necessary funds, personnel and security, as would enable it to hold the general elections in accordance with the Constitution.\u201d<\/p>\n<p>The CJP observed that in the cases of Punjab and KP, the then chief ministers tendered advice to their respective governors under Article 112(1) of the Constitution to dissolve the assembly.<\/p>\n<h2><a id=\"delay-in-holding-polls\" class=\"heading-permalink\" title=\"Permalink\" href=\"https:\/\/www.dawn.com\/news\/1738710\/kp-punjab-election-wont-tolerate-violation-of-the-constitution-says-cjp#delay-in-holding-polls\" aria-hidden=\"true\"><\/a>Delay in holding polls<\/h2>\n<p>The Punjab and KP assemblies \u2014 where the PTI had governments \u2014 were dissolved on\u00a0January 14\u00a0and\u00a0January 18, respectively, in an attempt to pave the way for snap polls.<\/p>\n<p>On Jan 24, the ECP wrote letters to the principal secretaries of Punjab and KP governors,\u00a0suggesting\u00a0elections in Punjab between April 9 and 13, and in KP between April 15 and 17.<\/p>\n<p>At the same time, the PTI had on Jan 27\u00a0approached\u00a0the LHC seeking orders for the Punjab governor to immediately announce a date for an election in the province following which the court had directed the ECP to immediately announce the date for elections after consultation with the governor.<\/p>\n<p>Meanwhile, President Arif Alvi had also\u00a0urged\u00a0the ECP on Feb 8 to \u201cimmediately announce\u201d the date for polls in KP and Punjab and put an end to \u201cdangerous speculative propaganda\u201d on both the provincial assembly and general elections.<\/p>\n<p>However, so far, the governors of the two provinces have refra\u00adined from providing any date for the polls on several pretexts.<\/p>\n<p>Last week, President Alvi had\u00a0invited\u00a0Chief Election Commissioner (CEC) Sikandar Sultan Raja for an urgent meeting regarding consultations on election dates but the ECP told him\u00a0he had no role\u00a0in the announcement of dates for general elections to provincial assemblies and the commission was aware of its constitutional obligation in this regard.<\/p>\n<p>Subsequently, the president on Monday unilaterally announced April 9 as the date for holding general elections for the Punjab and KP assemblies.<\/p>\n<p>The move drew\u00a0sharp criticism\u00a0from his political opponents, who accused him of acting like a PTI worker while the ECP said it would announce the poll schedule only after the \u201ccompetent authority\u201d fixes the date.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Chief Justice of Pakistan Umar Ata Bandial said on Thursday that the Supreme Court will not tolerate the violation of the Constitution as the top court began its suo motu hearing to determine who has the constitutional responsibility and authority to announce the date for elections to a provincial assembly after it was dissolved in [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":113624,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[54,23],"tags":[],"class_list":["post-113623","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-islamabad","category-national"],"_links":{"self":[{"href":"https:\/\/tns.world\/index.php?rest_route=\/wp\/v2\/posts\/113623","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/tns.world\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/tns.world\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/tns.world\/index.php?rest_route=\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/tns.world\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=113623"}],"version-history":[{"count":1,"href":"https:\/\/tns.world\/index.php?rest_route=\/wp\/v2\/posts\/113623\/revisions"}],"predecessor-version":[{"id":113625,"href":"https:\/\/tns.world\/index.php?rest_route=\/wp\/v2\/posts\/113623\/revisions\/113625"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/tns.world\/index.php?rest_route=\/wp\/v2\/media\/113624"}],"wp:attachment":[{"href":"https:\/\/tns.world\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=113623"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/tns.world\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=113623"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/tns.world\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=113623"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
