{"id":77301,"date":"2018-09-06T18:34:51","date_gmt":"2018-09-06T13:34:51","guid":{"rendered":"https:\/\/tns.world\/?p=77301"},"modified":"2018-09-06T18:36:07","modified_gmt":"2018-09-06T13:36:07","slug":"gay-sex-no-longer-a-crime-in-india-rules-sc","status":"publish","type":"post","link":"https:\/\/tns.world\/?p=77301","title":{"rendered":"Gay sex no longer a crime in India: rules SC"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p>New Delhi, Sept. 6 (TNS): Gay sex among consenting adults is not an offence, Indian Supreme Court ordered on Thursday, reading down a British-era section 377 of the penal code that penalises people for their sexual orientation.<\/p>\n<p>\u201cAny discrimination on the basis of sexual orientation violates fundamental rights,\u201d said Chief Justice Dipak Misra, reading out the operative portion of the top court\u2019s verdict that struck down Section 377 to the extent that it penalised consensual sexual relationship between two adults.<\/p>\n<p>\u201cSocial morality cannot be used to violate the fundamental rights of even a single individual&#8230; Constitutional morality cannot be martyred at the altar of social morality,\u201d he added.<\/p>\n<p>In four separate but concurring verdicts, the five judges of the top court ruled that the section failed to make a distinction between consensual and non-consensual acts.
